In mid-2009, LaPorta simply wanted to refinance his home... but later found out that there was no home to refinance, at least legally on paper! Here is factual evidence that will give you a good look on how Bank of America's deceptive business practices hurt consumers.

Date Event Documents POI SP

March 3, 2008 - July 29, 2008 First Horizon Home Loans either sold or transferred LaPorta's loans to Countrywide Bank FSB. This time period is gray because Bank of America was in the middle of merging with Countrywide. There must have been mass chaos as "the right hand probably did not know what the left hand was doing". This is essentially the start of the problems for LaPorta that would turn American home ownership into an American nightmare. N/A
July 1, 2008 Bank of America / Countrywide Merger is completed. Merger information is available through Charles Schwab and last updated on July 2, 2008. Countrywide Merger

First Horizon Home Loans records two Assignments of Deed of Trust to Countrywide Bank FSB with the Clark County, Nevada Recorder's Office. The merger of Countrywide into Bank of America was already completed on July 1, 2008. Why did First Horizon Home Loans record Assignments of Deed of Trust to an entity that no longer existed on this date? This was the first sign of LaPorta's legal problems with his home to come. Assignments of Deed of Trust
April 27, 2009 Countrywide Bank FSB merges with Bank of America, FSB. Document Systems, Inc. reports this merger on their website for compliance. Countrywide Bank FSB employees failed to record Assignments of Deed of Trust to Bank of America PRIOR to the merger being completed. You see, this leaves LaPorta in a state of limbo since he has no upward mobility with his home. At this time, LaPorta begins researching refinance opportunities with Bank of America. LaPorta continues a dialog with Mr. Ware. LaPorta states, Mr. Ware asks LaPorta verbally to give him with "$40,000 and maybe he will consider a refinance...". Mr. Ware ends the communications on October 3, 2009 at 3:37 PM stating "Bank of America does not have any other financing options available in refinancing your loan at this time.". LaPorta begins to sense something is just not right because there is always an option available. LaPorta begins to feel that he is being held "hostage" in is home. Why didn't Mr. Ware offer LaPorta the opportunity for a short sale or deed-in-lieu of foreclosure at this time? LaPorta and Ware Additional Communications

Bank of America records the November 17, 2011 manufactured "Corporation Assignment of Deed of Trust" with the Clark County, Nevada Recorder's Office for value received of $0.00. Why did Bank of America do this after more than 3.5 years of collecting payments from LaPorta without having a title to his home? LaPorta has had no upward mobility for 3.5 years to refinance, to lower his interest rate, sell the home "legally" or move on with his life since the house is "underwater" and only worth about $68,000. LaPorta is in effect held "hostage". Bank of America Corporation Assignment of Deed of Trust

The instrument numbers in the July 29, 2008 Assignments of Deed of Trust filed by First Horizon Home Loans do not match his property! The Compliance Investigator inspects and determines the July 29, 2008 Assignments of Deed of Trust filed by First Horizon Home Loans are non-factual and urges LaPorta to file a Consumer Complaint with the Nevada Attorney General's Office Bureau of Consumer Protection. Ms. Whittiker-Gish states that Ms. Kikisha Holmes was unavailable at this time. LaPorta inquires with Ms. Whittiker-Gish about the Deed-In-Lieu of Foreclosure Program (hmmm... How can LaPorta sign over the deed when it is in the name of First Horizon Home Loans?) as outlined in the letter from Ms. Holmes. LaPorta also directs Ms. Whittiker-Gish to the Expose Bank of America website. LaPorta also makes Ms. Whittiker-Gish aware on how Mr. Brian Moynihan tops the list of worst performing CEOs by CNN Money and how people on the street see Bank of America as a criminal enterprise. Ms. Whittiker-Gish asks LaPorta how she could help him. LaPorta discusses the letter he had sent to U.S. Senator Harry Reid more than 2 years ago (see the letter dated 7/3/2010 on this timeline). LaPorta discuses with Ms. Kim Whittiker-Gish on how he has no trust in Bank of America considering the issues LaPorta had to deal with over these past 3 years. LaPorta discusses the 3 individuals from Bank of America's Office of the President & CEO who have contacted him. LaPorta discusses the phone calls he received from Ms. Crystal Evans, Office of the President & CEO at Bank of America on what Bank of America could do for LaPorta at the direction of the OCC. LaPorta discusses mark-to-market (this would coincide with the two applications LaPorta has previously filed with the Nevada's Hardest Hit Fund - but this still doesn't leave Bank of America off the hook, LaPorta will still pursue criminal prosecutions and hold Bank of America employees and its attorneys accountable - Mitt Romney says, "Corporations are People"). LaPorta advises Ms. Whittiker-Gish that he would like something in writing by Bank of America for any consideration (i.e final negotiation) prior to the Nevada AB 284 Foreclosure Mediation filing because he, like many other Nevadans does not trust Bank of America considering everything he has been put through by this alleged criminal enterprise. Ms. Whittiker-Gish will forward the notes from this phone call to Ms. Holmes. Ms. Whittiker-Gish and LaPorta establish a time for Ms. Holmes to contact LaPorta. A letter by Ms. Kikisha Holmes, Home Loan Team, Bank of America, N.A. was included but there was no wet ink signature. LaPorta is told to respond by November 4, 2012. You see, Ms. Holmes and Bank of America only have paperwork in First Horizon Home Loans name and a robo-signed/manufactured mortgage assignment (recorded into the public record with the Clark County, Nevada Recorder's Office for a total value of $0.00). You see, Ms. Holmes is most likely in the prcoess of manufacturing documents to be filed with the State of Nevada for a forclosure. Is Ms. Holmes about ready to illegally foreclose on LaPorta's home using those First Horizon Home Loans documents and the robo-signed/manufactured mortgage assignment (recorded into the public record with the Clark County, Nevada Recorder's Office for a total value of $0.00). Does Ms. Holmes really think LaPorta is going to sign any paperwork for Bank of America to make a foreclosure legal? It would be in Ms. Holmes and Bank of America's best interest to write-off LaPorta's home (which is cheaper) than having to pay up to a million-dollar fine per violation under the first National Mortgage Settlement for non-compliance. Don't you agree, Ms. Holmes? Write it off, Ms. Holmes! That's what LaPorta wants. LaPorta made payments to Mr. Saborido to bring his First Horizon Home Loans current minus the late fees Bank of America had charged over a 5 month period. LaPorta received a letter, dated March 28, 2013 from a Ms. Jamila Humbert, Home Loan Team with Bank of America. Bank of America stated, "...you do not met the eligibility requirements to qualify for loan payment assistance or other alternatives to foreclosure inlcuding a short sale and deed-in-lieu of foreclosure". Is this because LaPorta's Deed of Trust is in the name of First Horizon Home Loans so there is nothing to short sale or any deed for LaPorta to sign over to Bank of America in a deed-in-lieu of foreclosure, right? It appears Mr. Kevin Smith and Ms. Jamila Humbert are doing everything in their power to keep the document cover-up going as long as they can. It's evident by their coorespondence. When did you ever hear of a bank tell you that you can't do a short sale or a deed-in-lieu of foreclosure? Does that bank have something to hide? When did you ever hear a bank purposely attempt to push a consumer into a forced foreclosure? Again, does that bank have something to hide? You bet! Bank of America Humbert Letter
April 24, 2013 LaPorta received a letter, dated April 24, 2013 from a Mr. Kevin Smith, Consumer Advocate with the Office of the CEO & President at Bank of America. Hey Kevin, did Fannie Mae contact you yet with updated paperwork in Bank of America's name? The only thing missing now is the deed in Countrywide or Bank of America's name, right? Are you going to robo-sign a new deed? It's tough when you can't assist the consumer with a short sale or a deed-in-lieu of foreclosure when you don't have the deed in Countrywide's or Bank of America's name, right? We know. We guess the deed you have in First Horizon Home Loans name is a bit of a problem, right? If you can't convey, LaPorta can't convey. On October 25, 2013, LaPorta's family provided assistance to pay off his 2nd Conventional Mortgage with First Horizon Home Loans. LaPorta, along with his family went to the Bank of America Branch located at 4361 N. Rancho Dr., Las Vegas NV 89130 (702-654-3600). LaPorta and family met with Personal Banker named Eder Trujillo who assisted in processing the pay off of LaPorta's 2nd Conventional Mortgage with First Horizon Home Loans. Mr. Tujillo had LaPorta speak with a Ms. Kristen McKell (sp) in the Bank of America Payoff Department. Ms. McKell advised LaPorta of the payoff amount for his 2nd Conventional Mortgage with First Horizon Home Loans along with details about the $21.00 recording fee for Clark County, Nevada. LaPorta's mother issued a check to Bank of America account #182648651. LaPorta's mother noted the account number as well as "To payoff First Horizon 2nd Mortgage" in the memo portion of the check. Bank of America accepted the payment and the check was cashed by Bank of America on the same day. Lender #3 was notified of the payoff of LaPorta's 2nd Conventional Mortgage with First Horizon Home Loans shortly afterwards.
Novmber 3, 2013 LaPorta looses his State of Nevada Hardest Hit Fund Principal Curtailment Reservation Commitment.
Novmber 5, 2013 Lender #3 requests a copy of LaPorta's driver's license and social security card to verify the link between his loan (LaPorta's 1st Conventional Mortgage is also with First Horizon Homes Loans) and his private mortgage insurance company (UGIC). Lender #3 stated that UGIC did not include this information when LaPorta's loan originally commenced and they needed his driver's license and social security card to link up with their underwriting systems. Bank of America is directly responsible for LaPorta loosing his State of Nevada Hardest Hit Fund Principal Curtailment Reservation Commitment due to this delay in processing my HARP 2.0 refinancing due to unknown PMI identity.

LaPorta received a response letter from a Duri Jun, Customer Advocate, Office of the CEO and President, Bank of America. Mr. Jun was responding to the Consumer Financial Protection Bureau, case number: 131017-000009 LaPorta filed previously on October 16, 2013. Mr. Jun states, "As such, Bank of America is unable to cancel the PMI insurance until those terms are satisfied." It appears Bank of America finds it acceptable to collection payments from LaPorta even while another lender can't verify LaPorta's identity with the PMI insurance company, UGIC. Novmber 19, 2013 Bank of America records a Substitution of Trustee and Full Reconveyance document with the Clark County, Nevada Recorder's Office. LaPorta received a response form letter from a Michael Durrance, Customer Advocate, Office of the CEO and President, Bank of America. The letter states, "... When is our government going to shutdown this criminal enterprise and return the tax-payer funded bonus money THEY GAVE THEMSELVES back to the American ppeople, like LaPorta? Why isn't law enforcement doing anything about this? If you or I did this we would go to jail, right? ReconTrust Video

Ms. Mendenhall states, "... my research confirms that your account was not in foreclosure during the months of January 2009 through December 2010" Alison, your a liar and you are exposed as one. Bank of America reported to the OCC on July 31, 2013 that YOU DID have foreclosure activity on LaPorta's home in 2009 and 2010. Alison, you don't give a crap about what your regulator says, huh? LaPorta received a response letter from a Michael Durrance, Customer Advocate, Office of the CEO and President, Bank of America. Mr. Durrance states, "... Bank of America has filed a corrective release for loans ending in 9401 and 8651." Michael, are you making sure you cover up all that Countrywide mortgage fraud so LaPorta couldn't talk about all of this in a court of law? Last time we checked Michael, Bank of America was found liable for Countrywide mortgage fraud. Is Michael trying to bury the Countrywide mortgage fraud by filing these corrective releases with county recorder offices around the USA? Don't you think it's time Michael goes to jail for attempts to conceal the Countrywide mortgage fraud? We do. Bank of America Durrance Letter

Bank of America filed mortgage assignments from First Horizon Home Loans to Bank of America with the Clark County, Nevada Recorder's Office. Why was this done more than 3 months after LaPorta obtained new financing with another lender and more than 4.5 years after LaPorta reported the issues NUMEROUS times (to law enforcement agencies) all while making payments to Bank of America? Was this done to conceal the Countrywide mortgage fraud (i.e. fraudulent Countrywide mortgage assignments submitted to a Federal Court by attorney's representing Bank fo America in LaPorta v. Bank Of America et al Case Number: 2:2011cv01094). Was this done to release LaPorta's home as a liability for Bank of America? If you or I do this in business we would go to jail. Why haven't Bank of America employees or attorney's representing Bank of America gone to jail? Why haven't criminal charges been brought up on Bank of America employees or attorney's representing Bank of America AFTER police reports have been filed citing factual evidence? Has law enforcement around the United States finally been bought and paid for by Bank of America to ensure they are immune from going to jail? Law enforcement is only there to protect criminal organizations like Bank of America. Besides LaPorta, there hasn't been ONE person in the justice community to STEP UP and DO SOMETHING to demand justice be served against Bank of America. Why haven't arrest warrants been issued? Why haven't any of the non-corrupt law enforcement agencies gone in and taken out these greedy, arrogant son-of-a-bitches from their corporate offices around the United States so justice can be served? America is in a very sad state of affairs because greed and arrogance has no bounds in 2014. Justice no longer works for the average American citizen. America has now officially become a banana republic.
October 22, 2014 Bank of America appears as Mortgagee on LaPorta's State Farm Homeowner's Insurance Renewal Certificate. Is Bank of America now trying to steal insurance money from LaPorta's current lender? Immediately today, LaPorta notified his current lender of this ongoing illegal activity by Bank of America. Obviously Bank of America (those greedy son-of-a-bitches) are licking their chops once more to now get at insurance money that doesn't belong to them. What a bunch of corporate CROOKS at Bank of America. Why the hell aren't these people in jail?
